Terms of Use
The terms that apply to your account, subscription, and use of PropertyNotes.io.
Agreement and eligibility
These Terms of Use are a contract between you and PropertyNotes.io. By creating an account, accepting an invitation, or using the service, you agree to these Terms and acknowledge the Privacy Notice. You must be at least 18 years old and able to form a binding contract.
If you use PropertyNotes.io for a company, agency, or other organization, you represent that you are authorized to accept these Terms for that organization. A signed order form, data-processing agreement, or other written agreement may add to these Terms; if it directly conflicts, the signed agreement controls for that customer.
Accounts, named users, and agency boundaries
- Named accounts. Each account is for one person. Keep account details accurate and do not share passwords, verification codes, sessions, or invitations.
- Separate agency boundaries. Each independent agency needs its own workspace, subscription, Book, billing record, and audit history unless a written custom agreement says otherwise. A named user may manage more than one properly licensed agency, but one agency’s plan never grants another agency access.
- Seats. Every active member and unexpired pending invitation uses one named seat. Seats may be reassigned to real personnel, but may not be pooled, rotated to avoid plan limits, or used to provide another business with access.
- Administration. Owners and admins control invitations, roles, billing, exports, and workspace settings. The organization is responsible for those decisions and for promptly revoking access when a person no longer needs it.
PropertyNotes.io may require reasonable business or account verification, reject an invitation, limit simultaneous or abnormal access, or ask an organization to move to a custom plan when use indicates multiple agencies, credential sharing, resale, or an attempt to avoid plan limits.
Free accounts, plans, and subscriptions
A free account may access previews, onboarding, invitations, or other features we make available without charge. Free access does not include paid agency entitlements and may have lower limits. We may change free features or limits, but we will not charge you without a separate checkout and authorization.
Paid plans include the named-seat, monitored-property, and brief allowances shown before checkout. Automatic overage charging is off unless you later approve separate overage terms. Plan limits do not promise that every source or feature is available for every address or jurisdiction.
Billing and renewal
Stripe displays the amount due, billing interval, recurring renewal price, and any eligible promotion before you subscribe. Subscriptions renew automatically for the interval selected until canceled. Taxes, if required, may be added at checkout. You authorize Stripe and PropertyNotes.io to process each recurring payment under the plan you approved.
Cancellation, plan changes, and refunds
An authorized billing admin may cancel through the same online billing area used to manage the subscription. Cancellation normally takes effect at the end of the paid period, and access continues through that date. You can review the effective date before confirming in Stripe. Unless required by law or expressly stated in a written offer, payments are nonrefundable and unused time or allowances do not roll over. If we make a billing error, contact support@propertybrief.io so it can be investigated and corrected.
Your data and responsibilities
You retain your rights in documents, client-book records, notes, and other material you submit. You grant PropertyNotes.io and its service providers a limited license to host, process, transmit, display, and secure that material only as needed to operate, support, and improve the service and meet legal obligations.
You represent that you have authority to submit and use that material, including any client or property information. Do not upload payment-card data, passwords, government identifiers, medical information, or other sensitive data unless a feature expressly requests it. You are responsible for exports and copies you share outside the service.
Research is evidence, not a decision
PropertyNotes.io organizes information from public records, published material, maps, listings, third-party services, and documents you provide. Sources may be delayed, incomplete, contradictory, blocked, or revised. A retrieved record does not prove current condition, ownership, completion, eligibility, coverage, issuance, renewal, claim outcome, or carrier acceptance.
You must verify the source, jurisdiction, date, exact property identity, and all material facts before quoting, binding, renewing, advising a client, or making a decision. PropertyNotes.io does not provide insurance, legal, tax, appraisal, engineering, inspection, or underwriting advice and does not make decisions for a carrier. See Data coverage and limitations.
Acceptable use
You may use PropertyNotes.io only for lawful internal business or personal professional work. You may not:
- share credentials, resell access, operate one workspace for separate agencies, or evade seats, quotas, source limits, or payment controls;
- access another customer’s data, probe security controls, introduce malware, disrupt the service, or use automated traffic that exceeds documented interfaces and limits;
- scrape, republish, or redistribute source material in violation of a source’s rights or terms;
- use the service for unlawful discrimination, surveillance, fraud, harassment, or a solely automated insurance or other legally significant decision; or
- reverse engineer or copy protected service elements except where the law clearly permits it.
Service operation and third parties
Features may depend on source coverage, account permissions, provider availability, jurisdiction, and feature availability. We may modify a feature, rate-limit use, suspend access, or remove unlawful or unsafe content to protect customers, providers, and the service. We will use reasonable efforts to give notice of material changes when practical.
Third-party services and source pages are governed by their own terms. PropertyNotes.io is not responsible for third-party content, outages, or decisions. References to a provider, public office, carrier, or product do not imply endorsement or a business relationship.
PropertyNotes.io rights and feedback
PropertyNotes.io and its licensors own the service, software, design, and related intellectual property, excluding your content and third-party source material. Subject to these Terms and your plan, you receive a limited, nonexclusive, nontransferable, revocable right to use the service.
If you submit feedback, you allow PropertyNotes.io to use it without restriction or compensation. Do not put passwords, verification codes, payment details, or unnecessary client information in feedback.
Disclaimers and limits of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available.” PropertyNotes.io disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted operation or that every result, alert, document, map, guideline, or source will be complete, current, or error-free.
To the maximum extent permitted by law, PropertyNotes.io will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. PropertyNotes.io’s aggregate liability arising from the service will not exceed the amount the applicable customer paid for the service during the 12 months before the event giving rise to the claim, or $100 if no amount was paid. These limits do not apply where applicable law does not permit them.
You will defend and indemnify PropertyNotes.io from third-party claims arising from your content, your unlawful or unauthorized use, your breach of these Terms, or your violation of another person’s rights, except to the extent caused by PropertyNotes.io’s own conduct.
Suspension, termination, and changes
You may stop using the service at any time; stopping use does not itself cancel a paid subscription. We may suspend or terminate access for nonpayment, security risk, legal requirements, material breach, or repeated misuse. Where practical, we will give notice and a chance to cure. Sections that by their nature should survive termination will survive, including payment obligations, ownership, disclaimers, liability limits, and indemnity.
We may update these Terms prospectively. We will post the updated date and provide additional notice for material changes when appropriate. Continued use after the effective date means you accept the updated Terms.
Law, questions, and notices
Florida law governs these Terms without regard to conflict-of-law rules, except where another law must apply. Before filing a claim, each side agrees to make a good-faith effort to resolve it by contacting the other. Nothing here prevents either side from seeking urgent injunctive relief or using a court with lawful jurisdiction.
